Port of Melbourne Corporation (PoMC) was established by the Victorian Government under the Port Services Act 1995 (Vic) (this version incorporates amendments as at 1 July 2004).

Portfolio responsibility rests with the Victorian Minister for Roads and Ports. However, on a range of matters affecting PoMC, the Minister has joint responsibility with the Victorian Treasurer.

Transport Integration Act 2010
Victoria has new legislation that brings together the transport portfolio, including ports and marine, under one principal Act.

The Transport Integration Act 2010 (Vic) came into effect on 1 July and replaces the Transport Act 1983 (Vic) as Victoria’s primary transport statute.

The Act ensures that any one part of the transport system is not considered in isolation. It also emphasises the importance of a sustainable transport system – in economic, environmental and social terms.

The Transport Integration Act requires all transport agencies to work together toward the common goal of an integrated, sustainable transport system.

It also means that agencies responsible for land-use planning will need to take into account the objectives and principles of the new Act when making decisions that will impact on the transport system.

Ports regulation review 2004

In 2004, the Essential Services Commission (ESC) conducted an enquiry into the regulatory arrangements in Victorian commercial ports. This was required under Section 53 of the Port Services Act 1995 .

In June 2004, the ESC submitted its Final Report on its findings to the Minister for Finance, the Minister responsible for the Essential Services Commission Act 2001 (Vic), and in March 2005 published their Price Monitoring Determination for the Victorian Ports.
